Privacy Notice

1. Introduction

This Privacy Notice (the “Notice”) describes Big B Corporation’s (“we” “us” or “our”) practices with respect to the collection, use, disclosure, and other handling of information about individuals (“you” or “your”) who use or interact with the automated online customer service and support chat services we provide (our “Technology”) to website operators (our “Clients”).  It also describes certain rights and choices that may be available to you regarding our use of your information.

Our Clients deploy our Technology on their websites to provide their visitors with a high-quality, automated customer service and support experience.  Our Technology also provides our Clients with insights into your interactions with the Technology and their websites.

We may update this Notice from time to time. We will post all such changes on this page and the Notice posted on this page will say when that version went into effect. If you use our Services after a change, then you will have accepted our updated Notice. You are advised to review our Notice periodically for any changes.

Our Technology is intended for use solely inside of the United States and Canada by United States and Canadian residents eighteen (18) years of age and older.  If you do not meet these criteria you are prohibited from using our Technology.

YOUR USE OF OUR TECHNOLOGY CONSTITUTES YOUR ACKNOWLEDGEMENT THAT YOU HAVE READ AND UNDERSTOOD THIS NOTICE AND AGREE TO THE PRACTICES DESCRIBED HEREIN.  IF YOU DO NOT AGREE WITH THIS NOTICE OR OUR PRACTICES, YOU ARE PROHIBITED FROM USING OUR TECHNOLOGY.

• Scope

This Notice applies specifically to our Technology and does not describe our collection, use, disclosure, or other handling of information through our corporate website located at lahzo.com.  For information on our practices with respect to our website please refer to the lahzo.com privacy policy.

This Notice does not pertain to the collection, use, disclosure, and other handling of information by our Clients that employ our Technology on their websites or by third-party websites or applications to which our Technology may link.  We are not responsible for the data practices of our Clients or other third parties.  For information on a third party’s collection, use, disclosure, and other handling of your personal information please refer to the applicable third party’s privacy notice.

• Types of Information Collected by Our Technology

Our Technology may collect information that identifies, relates to, describes, or could reasonably be linked with you or your household or is otherwise personal information, personal data, or an analogous term under applicable law (“Personal Information”). 

We may collect the following types of information from you when you interact with our Technology:

1. Personal identifiers including your name, alias, postal address, unique personal identifier, online identifier, information associated with a unique identifier (e.g., a cookie, tracking pixel, or other tracking technology), phone number, email address, and other identifiers you elect to provide.

   1. Information collected through cookies, pixel tags, and other tracking technologies (“Tracking Technologies”).

   1. Technical data including your IP address, device type, browser type and version, operating system, and other similar technical information.

   1. Behavioral data pertaining to your interactions with our Technology, the applicable Client’s website, and advertisements.

   1. Transcripts of your chats with our Technology.

Our Technology does not solicit or automatically collect sensitive Personal Information such as government identifiers, financial information, account credentials, racial or ethnic origin, citizenship, immigration status, religious or philosophical beliefs, union membership, health information, or information concerning your sexual orientation.  Please do not disclose any sensitive Personal Information through the Technology.

• How We Collect Information

Our Technology may collect information (including Personal Information) in the following ways:

1. You may provide information to us directly.  For example, you may elect to provide contact information and other information about yourself while communicating with our Clients through our Technology. 

   1. We automatically collect technical data each time your browser or device interacts with our Technology.  This may include your IP address, device type, browser type and version, operating system, and other technical information.

   1. We automatically collect behavioral data each time your browser or device interacts with the Technology.  For example, when you interact with the Technology, we may record the date and time of your interaction, the duration of your interaction, your activities on the applicable Client’s website, and click data.

   1. We automatically collect and retain transcripts of your communications with our Clients through our Technology and may monitor these communications.

   1. We may receive information about you and your interactions with us from third parties, such as marketing and advertising providers, ad networks, lead generators, data brokers, and companies that provide or sell lists of potential purchasers.

   1. We may use Tracking Technologies to, among other things, collect and store information about your use of the Technology.

2. How We Use Your Information

We may use information that is not Personal Information for any lawful business purpose.

We may share your Personal Information with the Client on whose website it is collected. 

We will not sell your Personal Information to third parties. 

We may use the Personal Information we collect to facilitate your communications with our Clients, to operate our Technology, and for our own internal purposes, including the following purposes:

1. To facilitate your interactions with our Clients through our Technology.  For example, when you use our Technology to chat with an automated customer service or support assistant, we will process the information you provide in order to generate and tailor chat responses.

2. To contact you or enable us and the applicable Client to contact you through the contact methods you provide.  For example, if you provide an email address, we and such Client may use that information to contact you via email.  If you provide your mobile number, we and such Client may use that information to contact you via voice, text, or SMS.  You consent to receive communications via the contact method you provide.

3. To enable the applicable Client to deliver marketing communications to you, including through the use of Tracking Technologies, subject to any legally required opt-in/opt-out mechanisms. 

4. To administer the Technology on behalf of the applicable Client.

5. To deliver analytics to the applicable Client. 

6. To manage, maintain, troubleshoot, develop, improve, train, analyze and optimize our Technology, products, and services and for our other internal business purposes.

7. To generate non-Personal Information (i.e., de-identified data). Once we generate non-Personal Information from any Personal Information, we will not later attempt to again make that information personally identifiable. However, we may combine and enhance that non-Personal Information with other non-Personal Information we receive or obtain from third parties.

8. Sharing Your Information

We may share information that is not Personal Information for any lawful business purpose.

We may share your Personal Information with the following categories of third parties:

1. The Clients with which you use our Technology to communicate.  However, we will not share your Personal Information with our other Clients.

   1. Our affiliates, namely, other companies that we control, are controlled by, or with which we are under common control.

   1. Our business partners, to offer you certain products, services, or promotions. By providing your contact information, you consent to receive communications from these partners via the contact method you provide.

   1. Third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with these third parties, which are designed to help safeguard your Personal Information. This means that they cannot do anything with your Personal Information unless we have instructed them to do it. They will also not share your Personal Information with any organization apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct. These are as follows:

We may also share or disclose your Personal Information in the following situations:

• In connection with, or during negotiations of, a merger, sale of our assets, financing, or acquisition of all or a portion of our business to another company.

  • If and as required by any court order, law or governmental or regulatory agency.

  • To enforce our policies.

  • For other purposes we disclose to you at the time we collect your Personal Information.

• Information Retention

We may retain information that is not Personal Information for such period as we determine in our exclusive discretion.

We will only keep your Personal Information for as long as it is necessary for the purposes set out in this Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). 

When we have no ongoing legitimate business need to store or process your Personal Information, we will either delete or de-identify such information, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion or de-identification is possible.

• Children’s Privacy

Our Technology is not targeted to anyone under the age of eighteen (18) and we do not knowingly collect Personal Information from anyone under the age of eighteen (18).  If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from a person under the age of eighteen (18), we will take steps to remove that information from our servers.

1. Foreign Residents

Our Technology is intended for use solely inside of the United States and Canada by United States and Canadian residents.  All other use is prohibited. We do not knowingly collect Personal Information from residents of countries other than the United States and Canada.  If you are aware that we have collected Personal Information from a non-United States or Canadian individual, please contact us.  If we become aware that we have collected Personal Information from a non-United States or Canadian individual, we will take steps to remove that information from our servers.

• California Privacy Rights

California Residents

California Civil Code Section 1798.83, also known as the “Shine The Light” law permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with us, you have the right to request removal of unwanted data that you publicly post on the Technology. To request removal of such data, please contact us using the contact information provided below and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed by us, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).

CCPA Privacy Notice

This section applies only to California residents. Under the California Consumer Privacy Act (CCPA), you have the rights listed below.

The California Code of Regulations defines a “resident” as: (a) every individual who is in the State of California for other than a temporary or transitory purpose, and (b) every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose.  All other individuals are defined as “non-residents.”

If this definition of “resident” applies to you, we must adhere to certain rights and obligations regarding your personal information.

Your rights with respect to your personal data

Right to request deletion of the data — Request to delete

You can ask for the deletion of your Personal Information. If you ask us to delete your Personal Information, we will respect your request and delete your Personal Information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of their right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.

Right to be informed — Request to know

Depending on the circumstances, you have a right to know:

1. Whether we collect and use your Personal Information.

2. The categories of Personal Information that we collect.

3. The purposes for which the collected Personal Information is used.

4. Whether we sell or share Personal Information to third parties.

5. The categories of Personal Information that we sold, shared, or disclosed for a business purpose.

6. The categories of third parties to whom the Personal Information was sold, shared, or disclosed for a business purpose.

7. The business or commercial purpose for collecting, selling, or sharing Personal Information.

8. The specific pieces of Personal Information we collected about you.

In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights

We will not discriminate against you if you exercise your privacy rights.

Right to Limit Use and Disclosure of Sensitive Personal Information

Our Technology does not solicit or automatically collect sensitive Personal Information such as government identifiers, financial information, account credentials, racial or ethnic origin, citizenship, immigration status, religious or philosophical beliefs, union membership, health information, or information concerning your sexual orientation.  Please do not disclose any sensitive Personal Information through the Technology.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use Personal Information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Other privacy rights

1. You may object to the processing of your Personal Information.

   1. You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information.

   1. You can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.

• Canadian Privacy Rights & Disclosures

This section applies only to Canadian residents.  Depending on applicable laws, you may have the following rights:

1. Right to obtain access to, rectify, or erase your Personal Information.

   1. Right to withdraw your consent to the collection, use, and transfer of your Personal Information.

   1. Right to be informed of a decision based exclusively on an automated decision.

   1. Right not to be discriminated against.

   1. Right to restrict and object to the use and processing of your Personal Information by us.

   1. Right to data portability via a copy of your Personal Information in a structured and commonly used format.

Depending on the right you are exercising, we will provide details on the procedure to follow, the expected processing time, and the information required. We aim to process your request within one calendar month from when we receive it. If we are unable to meet this timeframe, we will notify you and extend the deadline as allowed by applicable law.

Unless legally required or permitted to deny your request, we will provide you with details about the Personal Information we have collected about you or update and correct it as requested. If applicable law requires us to provide additional information about how your Personal Information is used or disclosed, we will also do so upon request.

Exceptions

If we do not agree to provide you with access to, or to rectify or erase, your Personal Information as requested or otherwise meet your requests, we will inform you of our decision. When applicable, we will explain the reasons for our decision and provide information on how you can appeal the refusal. If your request involves updating your Personal Information and it is denied, you may submit a statement regarding the proposed change, which we will attach to your record.

Subject to our obligations under applicable law, in some situations we may not be able to fulfill your request for access to or modification of your Personal Information, including when your Personal Information cannot be retrieved, the request is frivolous or vexatious, or providing access or otherwise meeting your request would:

1. be likely to pose a serious threat to individual or public safety;

2. be likely to unreasonably impact the privacy of others;

3. reveal information related to current or anticipated legal proceedings between us that is not available through the discovery process;

4. affect ongoing negotiations between you and us;

5. be unlawful, including if prohibited by a court or tribunal order;

6. be likely to influence actions related to alleged unlawful activities or misconduct in our operations;

7. be likely to affect enforcement activities conducted by relevant authorities; or

8. disclose evaluative information related to commercially sensitive decision-making processes.

Transfer of Personal Information

You acknowledge and agree that we are a United States company and that we may process your Personal Information in the United States and elsewhere.  In such cases, we will ensure that your Personal Information is protected through appropriate technical, organizational, contractual, or other lawful measures.

You acknowledge and agree that the recipients of your Personal Information outside of Canada will be subject to the privacy laws of their respective jurisdictions, which may differ from the Personal Information Protection and Electronic Documents Act, the information privacy principles set out in that Act, applicable provincial privacy legislation and other Canadian laws, rules, and regulations.

You acknowledge and agree to such international data and information transfers with respect to your Personal Information.

• Colorado Privacy Rights

This section applies only to Colorado residents. Under the Colorado Privacy Act (CPA), you have the rights listed below. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law.

• Right to be informed whether or not we are processing your personal data.

  • Right to access your personal data.

  • Right to correct inaccuracies in your personal data.

  • Right to request deletion of your personal data.

  • Right to obtain a copy of the personal data you previously shared with us.

  • Right to opt out of the processing of your personal data if it is used for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects (“profiling”).

• Connecticut Privacy Rights

This section applies only to Connecticut residents. Under the Connecticut Data Privacy Act (CTDPA), you have the rights listed below. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law.

• Virginia Privacy Rights

Under the Virginia Consumer Data Protection Act (VCDPA):

“Consumer” means a natural person who is a resident of the Commonwealth acting only in an individual or household context. It does not include a natural person acting in a commercial or employment context.

“Personal data” means any information that is linked or reasonably linkable to an identified or identifiable natural person. “Personal data” does not include de-identified data or publicly available information.

“Sale of personal data” means the exchange of personal data for monetary consideration.

If this definition of “consumer” applies to you, we must adhere to certain rights and obligations regarding your personal data.

Your rights with respect to your personal data

   1. Right to request deletion of your personal data.

   1. Right to obtain a copy of the personal data you previously shared with us.

We sell personal data to third parties or process personal data for targeted advertising. Please see the following section to find out how you can opt out from further selling or sharing of your personal data for targeted advertising or profiling purposes.

Exercise your rights provided under the Virginia VCDPA

You can opt out from the selling of your personal data, targeted advertising, or profiling by submitting an opt-out request via email at privacy@lahzo.com. 

If you are using an authorized agent to exercise your rights, we may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.

Verification process

We may request that you provide additional information reasonably necessary to verify you and your consumer’s request. If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request.

Upon receiving your request, we will respond without undue delay, but in all cases, within forty-five (45) days of receipt. The response period may be extended once by forty-five (45) additional days when reasonably necessary. We will inform you of any such extension within the initial 45-day response period, together with the reason for the extension.

Right to appeal

If we decline to take action regarding your request, we will inform you of our decision and reasoning behind it. If you wish to appeal our decision, please email us at privacy@lahzo.com. Within sixty (60) days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may contact the Attorney General to submit a complaint.

• Data Security

We employ reasonable security measures to prevent the loss, misuse, or accidental alteration of Personal Information collected by our Technology. However, no data transmission over the Internet or data security system can be guaranteed to be 100% secure or error-free.
